On 18 Oct 2024, the Critical Entities Resilience Directive (CER Directive) entered into application to ensure the protection of critical infrastructure across the EU.
The EU’s CER Directive creates a framework to support Member States of the European Union (EU) in ensuring that critical entities are able to prevent, resist, absorb and recover from disruptive incidents, including those caused by natural hazards, terrorism, insider threats, sabotage or public health emergencies.
Under the CER Directive, EU countries will have to carry out a risk assessment on essential services and will have to identify critical entities by 17 July 2026. Once identified as critical, these entities will have to carry out their own risk assessments and adopt resilience-enhancing measures to better prevent, respond to and mitigate incidents disrupting the provision of essential services.
The new Directive replaces the European Critical Infrastructure Directive of 2008. A critical entity is considered of particular European significance if it provides essential services to six or more EU states.
The Commission has proposed a non-exhaustive list of essential services that are crucial for the maintenance of vital societal functions, economic activities, public health and safety, or the environment. It covers 11 sectors such as energy, transport, banking, financial market infrastructures, health, drinking water, wastewater, digital infrastructure, public administration, space and food.
Businesses across the EU, as well as those doing business with the EU now have to comply with the new legislations like CER Directive and The Digital Operational Resilience Act (DORA). This is expected to drive demand for specialist consultancies, intelligence and resilience platforms.
